Terms and Conditions for Experience Booking

Booking Agreement

By completing your purchase, you are entering into an agreement for our company to arrange an experience led by professional guides. We carefully select and hire fully insured and permitted guides to conduct the activities you have selected. Your payment secures both our services in arranging the experience and the services of the professional guide who will lead your activity.

Refund and Rescheduling Policy

• Cancellations made 14 or more days prior to the scheduled experience date will qualify for a full refund or the option to reschedule to another available date.
• Cancellations made less than 14 days prior to the scheduled experience date are non-refundable and cannot be rescheduled unless your spot can be filled from a waitlist, in which case a full refund or rescheduling option will be provided.
• No refunds or rescheduling will be provided for no-shows or cancellations on the day of the experience.
• We reserve the right to cancel experiences due to unsafe conditions, in which case a full refund or rescheduling option will be provided.

Participant Responsibilities and Risk Acknowledgment

By purchasing this experience, you agree to the following terms that will also be presented in a liability release form to be signed prior to participation:

Business Structure and Guide Relationship

You acknowledge that our company serves as an experience reseller, not a guide service provider. We hire professional, fully insured and permitted guides as independent vendors to lead your experience. These guides are not our employees but are independent professionals we contract to provide expert guidance and safety oversight. You agree to participate in activities within your comfort level and abilities and to communicate with your hired guide if at any time you feel uncomfortable or unable to continue.

Safety and Protective Gear

You agree to wear all safety/protective gear as recommended by your guide for the outdoor activities you will engage in, including helmets, appropriate footwear, and padding as required.

Voluntary Participation and Inherent Risks

You understand that you have chosen to voluntarily participate in an outdoor activity that may include travel in a vehicle, skiing, boating, horseback riding, rock climbing, hiking, mountain biking, dirt biking, and/or other moderate to high-risk activities through mountainous, desert or coastal terrain.

You acknowledge that these activities have inherent risks that cannot be eliminated without destroying the unique character of the activities. These risks include but are not limited to:

• Risk of collision during vehicular travel that could result in physical/emotional injury, trauma, or death
• Altitude-related illnesses at elevations above 8,000 feet
• Limited access to immediate medical care in remote wilderness areas
• Hazards related to foot travel on unstable or unpredictable terrain
• Environmental risks including extreme weather, wildlife encounters, insect bites, poison ivy, avalanche, flash floods, wildfire, and lightning
• Risks arising from decisions made by participants and guides in wilderness settings

Release of Liability

In consideration of being permitted to participate in these events and activities, you release, waive, and discharge our company, our hired guides, their officers, employees, agents, and volunteers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, while participating in such activities, whether caused by negligence or otherwise.

Indemnification

You agree to indemnify and hold harmless our company and our hired guides from any loss, liability, damage, or costs, including court costs and attorney fees, that may be incurred due to your participation in said activities.

Medical Authorization

In the event of an emergency, you authorize our hired guides to secure from any licensed hospital, physician, and/or medical personnel any treatment deemed necessary for your immediate care and agree that you will be responsible for payment of any and all medical services rendered.

Additional Terms

• You must be 18 years or older to book an experience. Participants under 18 must be accompanied by a parent or legal guardian who can sign the liability release on their behalf.
• Our company reserves the right to refuse service to anyone.
• By proceeding with this purchase, you confirm that you have read, understood, and agree to these terms and conditions.

By completing your purchase, you acknowledge that you have read, understood, and agree to the terms outlined above, and that you will sign the detailed liability release form provided by your guide before participating in the experience.
